These Terms of Service govern your access to and use of the Itinerak website, WordPress plugin, subscription plans, licensing services, APIs, and related travel itinerary technology.
By subscribing to, installing, accessing, or using Itinerak, you agree to these Terms of Service. Please read them carefully before using the service.
About Itinerak & Acceptance of Terms
About the service
Itinerak is a travel technology service that provides a WordPress plugin connected to the Itinerak platform and route-generation system.
The service is designed to allow travel websites to offer interactive itinerary planning directly to their visitors. Depending on the subscription plan, access may include different destinations, features, licensing options, or levels of service.
Acceptance of these Terms
By subscribing to an Itinerak plan, activating a license, installing or using the Itinerak plugin, or otherwise accessing the service, you agree to be bound by these Terms of Service.
If you are using Itinerak on behalf of a business, organization, or website owner, you confirm that you have the authority to accept these Terms on their behalf.
If you do not agree with these Terms, you should not subscribe to, activate, or use the Itinerak service.
Visitors who use an itinerary planner embedded on a customer’s travel website are not required to create an Itinerak account or purchase an Itinerak subscription simply to generate a travel itinerary.
Subscriptions, Plans & Licenses
Subscription plans
Access to Itinerak may be provided through different subscription plans. Each plan may include specific limits, destinations, features, website allowances, branding options, or other capabilities as described on the Itinerak website at the time of subscription.
Features and usage limits available to a customer are determined by the active subscription plan associated with their license.
License to use Itinerak
An active subscription grants the customer a limited, non-exclusive, non-transferable right to use the Itinerak plugin and connected services in accordance with the conditions and limits of the selected plan.
Purchasing or subscribing to Itinerak does not transfer ownership of the plugin, route-generation technology, platform, software, databases, APIs, or other proprietary Itinerak technology to the customer.
Website domain
An Itinerak license may be associated with a specific website domain or with a number of websites permitted by the applicable subscription plan.
Customers are responsible for providing the correct website domain when required for license activation and for using the license only within the limits of their subscription.
Plan limits
Customers may not intentionally bypass, disable, manipulate, or circumvent license checks, plan restrictions, destination limits, website limits, branding requirements, or other technical restrictions associated with their subscription.
The Itinerak software, platform, route technology and underlying systems remain the property of Itinerak. Customers receive permission to use the service according to the terms and limits of their active plan.
Payments, Renewals & Cancellation
Payments
Payments for paid Itinerak plans are currently completed manually through PayPal. Customers receive the relevant payment details and complete the payment directly through PayPal.
Itinerak does not automatically charge a customer’s PayPal account, credit card, bank account, or other payment method. Payment processing is handled by PayPal according to its own terms and policies.
Subscription period
A paid subscription remains active for the subscription period purchased by the customer, subject to these Terms and the conditions of the selected plan.
The applicable price, subscription period, and included features are those communicated or displayed for the selected plan at the time of purchase.
Renewals
Unless otherwise expressly agreed, Itinerak subscriptions do not renew through an automatic charge. To continue using a paid plan beyond the current subscription period, the customer must complete the required renewal payment.
If a subscription is not renewed, access to paid features or services associated with that subscription may expire, be suspended, or return to the level of access otherwise available without the paid subscription.
Cancellation
Because payments are not automatically recurring, customers can choose not to renew their subscription at the end of the current paid period.
Customers may also contact Itinerak regarding their subscription or license at any time. Ending or choosing not to renew a subscription does not transfer ownership of Itinerak software, technology, data, or services to the customer.
Refunds
Any request for a refund will be considered according to the circumstances of the purchase, the service already provided, and any refund terms communicated by Itinerak at the time of purchase. Nothing in these Terms limits any refund or consumer rights that cannot legally be excluded under applicable law.
Itinerak does not automatically charge customers for subscription renewals under the current payment system. Continued access to a paid subscription requires renewal in accordance with the payment process provided by Itinerak.
Permitted Use & Customer Responsibilities
Customers may use Itinerak to provide itinerary planning functionality on websites covered by their active subscription and license.
Customers are responsible for using the service lawfully, maintaining the security of any license information provided to them, and ensuring that their use of Itinerak complies with these Terms.
Permitted use
Subject to an active subscription and the limits of the selected plan, customers may install and use the Itinerak plugin on authorized websites and make the itinerary planning experience available to visitors of those websites.
Prohibited use
Customers may not misuse Itinerak or attempt to obtain access beyond what is provided by their subscription. In particular, customers must not:
- Share, resell, transfer, or distribute a license except where expressly permitted by the applicable plan.
- Use a license on websites or domains beyond the limits of the active subscription.
- Circumvent, disable, manipulate, or interfere with license verification, plan restrictions, or access controls.
- Attempt to gain unauthorized access to the Itinerak API, servers, infrastructure, databases, or administrative systems.
- Use automated methods to abuse, overload, scrape, extract, or make excessive requests to the Itinerak service or API.
- Copy, reproduce, redistribute, or commercially exploit proprietary Itinerak software, route-generation systems, databases, or other protected technology except as expressly permitted by Itinerak.
- Use Itinerak for unlawful, fraudulent, abusive, or harmful purposes.
Customer websites
Customers remain responsible for their own websites, content, legal notices, visitors, and compliance with laws applicable to their website or business. The availability of Itinerak on a customer website does not make Itinerak the operator or publisher of that website.
The service is intended to be used normally through the Itinerak plugin and authorized platform functionality. Attempts to bypass licensing or gain unauthorized access may result in suspension or termination of access.
Intellectual Property
Itinerak and its underlying technology are proprietary products. Except for the limited rights granted to customers under an active subscription, no ownership rights are transferred through the purchase, installation, or use of the service.
Itinerak technology
The Itinerak software, WordPress plugin, platform, APIs, route-generation systems, databases, interface elements, documentation, branding, and other original technology or materials provided as part of the service remain the property of Itinerak or their respective rights holders.
Customers may use these elements only as necessary to access and operate the service in accordance with their active subscription and these Terms.
Generated itineraries
Customers may display itineraries generated through Itinerak on websites authorized by their subscription and may make those itineraries available to visitors as part of the normal use of the service.
This permission to display generated itineraries does not grant the customer ownership of, or unrestricted rights to reproduce, extract, copy, redistribute, resell, or create a competing database or route-generation service from Itinerak’s underlying data, systems, or technology.
Itinerak name and branding
The Itinerak name, logo, visual identity, and related branding may not be copied, misrepresented, or used in a way that suggests an unauthorized partnership, endorsement, or ownership.
Where a subscription plan includes white-label or branding customization features, customers may use those features within the scope provided by that plan. Such customization does not transfer ownership of the underlying Itinerak technology.
Customers retain ownership of their own websites and original content. Itinerak retains ownership of its software, infrastructure, route technology, databases, branding, and other proprietary components.
Service Availability, Updates & Changes
Service availability
Itinerak aims to provide a reliable and continuously available service. However, uninterrupted or error-free availability cannot be guaranteed at all times.
Access to the plugin, APIs, route-generation systems, licensing services, or other parts of the platform may occasionally be interrupted due to maintenance, updates, technical issues, hosting or network conditions, security measures, or events outside our reasonable control.
Updates and improvements
Itinerak may update, improve, modify, or replace parts of the service as the platform evolves. This may include changes to the plugin, APIs, route-generation technology, destination data, itinerary logic, interface, documentation, or other service features.
Customers may be required to install an updated version of the Itinerak plugin when an update is necessary for compatibility, security, functionality, or continued access to the service.
Features and destinations
Available features, destinations, route options, and other capabilities may evolve over time. Itinerak may add, modify, replace, or discontinue individual features or content where reasonably necessary to maintain or improve the service.
Where a material change significantly affects a paid service, Itinerak will make reasonable efforts to communicate the relevant change to affected customers when appropriate.
Maintenance and temporary interruptions
Temporary interruptions required for maintenance, security, infrastructure changes, or technical improvements do not constitute a permanent discontinuation of the service.
We may continue improving the platform, route technology, destination coverage, and plugin functionality while working to maintain a reliable experience for customers and their website visitors.
Travel Information & Generated Itineraries
Itinerak provides travel itinerary technology designed to help users organize and explore destinations. Generated itineraries are provided for planning and informational purposes.
Generated routes
Itineraries are generated using destination data, route logic, travel preferences, and other information available to the Itinerak system.
Although we work to provide useful, realistic, and high-quality itineraries, a generated route should not be considered a guarantee that every attraction, restaurant, activity, or service will be available exactly as presented.
Information may change
Opening hours, admission prices, transportation conditions, reservation requirements, accessibility, temporary closures, local events, and other destination information can change without notice.
Travelers should verify important or time-sensitive information directly with the relevant attraction, venue, transportation provider, restaurant, or other official source before relying on it for travel decisions.
Travel decisions
Generated itineraries are planning suggestions rather than professional travel, safety, legal, medical, immigration, or other specialized advice.
Travelers remain responsible for their own bookings, transportation, documentation, reservations, personal safety, travel decisions, and compliance with local laws and requirements.
Third-party places and services
References to attractions, restaurants, hotels, transportation providers, businesses, or other third-party places and services do not mean that Itinerak owns, operates, controls, or guarantees those third parties.
Itinerak helps create structured travel itineraries, but real-world conditions can change. Important details such as opening hours, prices, reservations, and availability should be confirmed with the relevant official source.
Limitation of Liability
Itinerak is provided as a travel technology and itinerary planning service. While we work to maintain a reliable, useful, and accurate service, the platform and its content are provided subject to the limitations described in these Terms.
Use of the service
To the maximum extent permitted by applicable law, Itinerak is not responsible for losses or damages resulting from a customer’s or traveler’s reliance on generated itineraries, destination information, third-party information, or changes in real-world travel conditions.
This includes circumstances involving changes to opening hours, prices, availability, transportation, reservations, closures, local conditions, or information controlled by independent third parties.
Technical availability
Itinerak does not guarantee that the website, plugin, APIs, licensing systems, route-generation services, or other platform functionality will operate without interruption, delay, or error at all times.
To the maximum extent permitted by applicable law, Itinerak will not be liable for indirect, incidental, consequential, special, or similar losses arising from temporary service interruptions, technical failures, compatibility issues, maintenance, or events outside our reasonable control.
Customer websites
Customers are responsible for maintaining, securing, and operating their own WordPress websites and for ensuring that their themes, plugins, hosting environment, and other software are appropriately maintained.
Itinerak is not responsible for problems caused by third-party plugins, themes, hosting providers, custom code, unauthorized modifications, or other systems outside the reasonable control of Itinerak.
Rights that cannot be excluded
Nothing in these Terms excludes or limits any liability, warranty, consumer protection, or other right that cannot legally be excluded or limited under applicable law.
These limitations are intended to define the reasonable scope of responsibility for a travel technology service. They do not remove rights or protections that applicable law requires Itinerak to provide.
Suspension & Termination
Access to Itinerak depends on compliance with these Terms and, where applicable, the continued validity of the customer’s subscription and license.
Expiration or non-renewal
When a paid subscription reaches the end of its purchased period and is not renewed, access to paid features and services associated with that subscription may expire or become unavailable.
Because Itinerak does not currently use automatic subscription billing, choosing not to complete a renewal payment is sufficient to allow a paid subscription to expire at the end of its current period.
Suspension of access
Itinerak may temporarily suspend a license or access to the service when reasonably necessary to protect the platform, investigate suspected misuse, address a security issue, or enforce these Terms.
Reasons for suspension may include unauthorized license use, attempts to bypass plan restrictions, abusive or excessive API activity, unauthorized access attempts, fraudulent use, or other material violations of these Terms.
Termination for violations
Itinerak may terminate access to the service when a customer materially or repeatedly violates these Terms, misuses the service, compromises the security or operation of the platform, or uses Itinerak for unlawful purposes.
Where reasonably appropriate, we may provide the customer with an opportunity to resolve a violation before permanent termination. Immediate action may be taken where necessary to protect the service, its infrastructure, customers, or other users.
Effect of termination
When a license or subscription ends, the customer’s right to use paid Itinerak services and features associated with that license also ends.
Termination does not transfer ownership of the Itinerak plugin, platform, APIs, route technology, databases, branding, or other proprietary materials to the customer.
Suspension and termination measures are intended to protect the service from misuse and enforce subscription limits. Customers using Itinerak normally within the conditions of their active plan are not affected by these provisions.
Changes to These Terms
Itinerak may update these Terms of Service from time to time as the service, technology, subscription plans, business practices, or legal requirements evolve.
Updates to the Terms
Changes may be made to reflect new features, changes to subscription plans, licensing arrangements, payment methods, technical functionality, security requirements, or other developments affecting the Itinerak service.
The most current version of these Terms will be published on this page, and the “Last updated” date at the top of the page will be revised when changes are made.
Material changes
If a change materially affects an existing paid subscription or the customer’s rights or obligations, Itinerak will make reasonable efforts to provide appropriate notice where necessary.
Changes will not remove rights that customers are entitled to under applicable law.
Continued use
Continued use of Itinerak after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
If a customer does not agree with updated Terms, they may stop using the service and choose not to renew their subscription, subject to any rights or obligations that already apply.
As Itinerak develops, these Terms may evolve with it. The current version will always be available on this page so customers can review the conditions governing their use of the service.
